- UNEP FI Freshfields Bruckhaus Deringer legal duties study – A legal framework for the integration of environmental, social and governance issues into institutional investment
(PDF 1257KB or 1.3MB)
The report confirms that a number of the perceived limitations on the integration of environmental, social and governance (ESG) issues into investment decision-making are illusory. In fact, the law clearly permits and, in certain circumstances, requires that this be done. It concludes that the traditionally held view, that fund managers are precluded from taking ESG considerations into account in their investment decision-making, is unlikely to be applied by the courts in future, and that fund managers will in most circumstances be permitted, and even required, to take ESG considerations into account when making investment decisions.
