About the Clayton South, Clarinda and Dingley Village Area

From the 1890s, much of the Clayton South area was used for sand quarrying. This was followed by intermittent land filling, which became more prevalent in the 1960s. Market gardens have operated in this area since the early 1900s.

The Clayton and Dingley areas have seven operating landfills able to receive waste under an EPA licence.  The area also has two operating green waste facilities.

EPA Southern Metro officers held an information stall at the Dingley Village craft marketEPA’s regulatory work in Clayton South continues with three new enforcement notices issued to the operators of Clayton Regional Landfill and Din San Nursery. EPA’s Southern Metro Manager Bronwyn Green said the sites required significant investment by their operators, with Clayton Regional landfill alone requiring close to $3 million worth of works.


While EPA has been actively involved in setting compliance deadlines for these operators, the sites will be subject to ongoing monitoring by EPA and stakeholders, including Kingston City Council, to ensure they meet the day to day obligations of managing their sites.

EPA Victoria’s 24 hour Pollution Hotline takes calls from the Victorian public in relation to pollution, environmental hazard or other activities potentially harmful to the environment. The graph below shows the volume of calls made to the Pollution Hotline since November 2010.


EPA encourages residents to call and report odour issues. To assist us with our work, it is important you call EPA as soon as you are aware of the odour. Delaying your call or sending it via e-mail will not provide EPA officers with the best chance of being able to verify your report.

 

The role of EPA

As an effective environmental regulator EPA’s role is to monitor industry and ensure it complies with the Environment Protection Act 1970 (EP Act) and the Pollution of Waters by Oils and Noxious Substances Act 1986 (POWBONS Act). The Act establishes the powers, duties and functions of EPA.

Under the Act, EPA Victoria can ensure compliance with the law in a number of ways. These powers and how they can be used are outlined in EPA’s Compliance and Enforcement policy. The policy talks about two key elements of enforcement: remedy – fixing a problem or preventing an incident, and sanction – applying a penalty for breaking the law.

EPA actions

EPA has taken action across the Clayton South, Clarinda and Dingley areas to stop offensive odours going beyond site boundaries.  EPA action falls into two categories:

    1. Inspecting sites and working with the operators to ensure that the issues that lead to odours off-site are fixed; and
    2. Using its statutory powers under the Environment Protection Act 1970 to ensure operators comply with their operating requirements. 

Statutory Notices, Directions and Enforcement

Since November 2010 EPA has issued 11 notices, relating to odours in the Clayton South, Clarinda and Dingley Village area. 

EPA has also issued Penalty Infringement Notices, carrying an approximate $6000 penalty, to Transpacific Waste Management Pty Ltd (Victory Road Green Waste Transfer Station), Ernest Smith Contractors Pty Ltd (Din San) and Enviromix Pty Ltd for offensive odours sourced from their site being detected within residential areas. 

EPA is continuing to investigate a number of sites for potential significant breaches of their licences with the view to enforcement action.
