Terminals Pty Ltd (WA 69526)

EPA accepted a works approval application from Terminals Pty Ltd (“Terminals”) on 2 June  2011.  This proposal is to install a liquid coal tar pitch storage facility.  The proposed facility consists of two new heated 4.1ML storage tanks, one natural gas fired hot oil heater, truck loading gantry and associated piping and dock lines for ship unloading.

The works approval application was advertised in the Herald Sun and Geelong Advertiser on 15 June 2011.   EPA received 3 submissions. The detailed submissions are attached below.

EPA held a public conference on 10 August 2011 inviting all interested parties, pursuant to section 20B of the Environment Protection Act 1970.   The 20B conference report is available below.

Following the conference, EPA issued a notice (attached below) pursuant to section 22 of the Environment Protection Act 1970, to Terminals Pty Ltd seeking further information.  On 2 September, Terminals responded to EPA with additional information (attached below). 

EPA forwarded copies of the 20B Conference Report and Terminals’ responses to WorkSafe, Deptartment of Health and the CFA.  Subsequently, Department of Health provided a response (attached below).  EPA will continue discussions with the Department prior to licensing the pitch storage facility.

EPA’s assessment of the works approval application determined that the proposal is consistent with the Environment Protection Act 1970, the relevant State Environment Protection Policies and best practice guidelines. EPA considered all comments and issues raised, during the public consultation process, when making the decision.

EPA issued the works approval (attached below) to Terminals Pty Ltd on 3 October 2011.  An application for third party review has been lodged with the Victorian Civil and Administrative Tribunal (“VCAT”).
