On 20 December 2016, the Governor in Council approved the Environment Protection (Industrial Waste Resource) Amendment (Performance Standard) Interim Regulations 2016.
These Interim Regulations, recommended by the Department of Environment, Land, Water and Planning (DELWP), change the requirements for approval of the conditions under which non-liquid prescribed industrial waste (PIW) may be transported for destruction or deposit.
Specifically, the Interim Regulations amend Industrial Waste Resource Regulation 26(3)(b). This now allows EPA to approve transport of such PIW if it is satisfied the receiving facility has equal to or better environmental performance standards than a facility that is licensed to receive waste or exempt from the requirement to hold a licence. Previously, EPA had to be satisfied such a facility had better environmental performance standards.
The Interim Regulations expired on 19 July 2017. After that date, DELWP will engage with the community, industry and other interested parties in developing permanent amendments to the regulations.

EPA is now assessing applications for transport of PIW under these amended Regulations. The Interim Regulations are not retrospective and do not change previous EPA decisions on applications for transport of PIW.
