Compliance and enforcement


EPA issued 29 environmental Penalty Infringement Notices (PINs). Each PIN is worth around $7,000. Thirty-six Official Warnings were also issued for identified non-compliances. This is a slight increase from the previous year.

EPA successfully concluded one prosecution in 2013 –14, when Hyde Park Tank Depot Pty Ltd pleaded guilty to an air pollution charge and a breach of licence charge and was ordered to pay $40,000 to Western Melbourne Catchments Network Incorporated to manage and coordinate the funding of a seed production along Kororoit Creek and the Federation Trail at Altona. Hyde Park was also ordered to pay EPA’s costs of $13,825.30.

Goulburn Valley Water entered into an Enforceable Undertaking (EU) with EPA to improve the environment after storing industrial waste at 34 sites without a licence. Under the EU Goulburn Valley Water is required to complete a risk assessment and rehabilitation works, update operating procedures, management systems and implement training at a cost of $100,000. In addition, they were required to provide $150,000 to fund environmental projects on land along Broken-Boosey Nine Mile Creek to protect native vegetation and improve freshwater habitat for endangered species. They will also spend $100,000 on industry-wide environmental performance improvement.

EPA also commenced 20 comprehensive investigations (CIs) in 2013 –14 to assess whether EPA has grounds to prosecute duty holders for particular non-compliances.
