1,000 litre spill gets a $2,000 fine

A member of the public reporting a spill has led EPA Victoria to fine a dairy farmer at Mirboo North for allowing dairy effluent to flow into a creek.

The man has been fined $2,035 for depositing more than 1,000 litres of dairy effluent into Ogrady Creek, an offence under Section 115 of the Environment Protection Act 2017.

EPA Authorised Officers inspected the property on Limonite Rd in Mirboo North, and found that effluent had discharged from an effluent pond into the creek, posing a significant risk to aquatic life, water quality and livestock downstream.

EPA issued the man with an improvement notice requiring that he take action to stop the current overflow, repair the system to prevent any future leaks, and review effluent management practices on the farm.

Under the Environment Protection Act 2017 and the Infringements Act 2006, the operator has the right to have the infringement notice reviewed or be considered by a court.
