Without conviction, ordered pursuant to s.67AC of the Act:
1. To carry out a specified project for the public benefit by paying $10,000 within 28 days to the Upper Maribyrnong Catchment Group Inc.
2. To provide proof of payment of $10,000 to the Upper Maribyrnong Catchment Group Inc. within 60 days.
3. That the payment be used to enhance the environmental quality of the Wallan Creek and hence the Merri Creek Catchment by conducting invasive species removal, mulching, noxious weed control, re-vegetation of riparian zone of Wallan Creek and biodiversity enhancement in and around the Wallan Creek.
4. To refrain from referring to the payment without reference to the proceedings.
5. To publish a notice in relation to the proceedings.
6. To ensure the notice is to
(a) be in the terms specified in clause 8;
(b) be published within 7 days of the date of the Court Order;
(c) be published in the Early General News section of the following newspapers;
(i) Financial Review;
(ii) Herald Sun;
(d) be of a minimum size of 12cm by 3 columns;
(e) contain the company’s corporate logo.
7. To display the notice in the “latest news” and “environment” sections of the company’s website for 60 days.
8. To provide the Informant with a copy of each of the published notices within 7 days of the notice appearing.
