    DL_C01
    Commissioning activities must be undertaken in accordance with the commissioning plan approved by the Authority.
    DL_C02
    You must immediately notify the Authority by calling 1300 EPA VIC (1300 372 842) in the event of: a) A discharge, emission or deposit which gives rise to, or may give rise to, actual or potential harm to human health or the environment; b) A malfunction, breakdown or failure of risk control measures at the site which could reasonably be expected to give rise to actual or potential harm to human health or the environment; or c) Any breach of the licence.
    DL_C03
    Construction and commissioning activities permitted under this licence must not cause or result in any breach of any permission issued by the Authority for the permission activity, except where authorised by a condition of this licence.
    DL_C05
    1. You must develop a risk management and monitoring program for your activities which: (a) identifies all the risks of harm to human health and the environment which may arise from the activities you are engaging in at your activity site; (b) clearly defines your environmental performance objectives; (c) clearly defines your risk control performance objectives; (d) describes how the environmental and risk control performance objectives are being achieved; (e) identifies and describes how you will continue to eliminate or minimise the risks in 1(a) (above) so far as reasonably practicable; and (f) describes how the information collated in compliance with this clause, is or will be disseminated, used or otherwise considered by you or any other entity. 2. The risk management and monitoring program must be: (a) documented in writing; (b) signed by a duly authorised officer of the licensed entity (c) made available to the Authority on request.

    Within 60 days of the completion of the approved activities, you must provide to EPA a written report that summarises the activities undertaken and includes: a) a commissioning report that summarises the results of all commissioning activities; b) a procedure for full shut down that minimises expected flare use and includes communication with affected noise sensitive receivers when flare activation is planned; c) a biofilter maintenance and management plan in accordance with EPA Publication 1880; d) a routine water quality monitoring plan for the 375kL dam; e) an emergency response plan for: i) spill containment and clean up, ii) contamination of the 375kL surface water catchment pond, iii) containment of firewater and management of contaminated fire water runoff; f) operational protocols to ensure that depackaged wastes or digestate are not stockpiled outside of the waste receival shed.
    DL_C09
    You must not accept or store more than 500 tonnes (consisting of 480 tonnes of unpackaged wastes and 20 tonnes of packaged wastes) of wastes at the activity site for the duration of this permission.
    DL_C10
    You must ensure that: a) Only waste of a type shown in Appendix 4 of this approval is accepted at the activity site; and b) If it is identified that any waste has been received at the activity site that is of a type not shown in Appendix 4 in contravention of paragraph a) above, such waste must be placed in a designated and sign-posted temporary storage area and sent for disposal to a site authorised by the Authority to receive such waste within 21 days of the date it was received.

    Waste from the activity site must not be discharged or disposed of to the environment except in accordance with this permission and with any other permission issued by the Authority that may relate to the activity site.
    DL_G01
    A copy of this licence must be kept at the site and be easily accessible to persons who are engaging in an activity conducted at the site. Information regarding the requirements of the licence and the Act duties must be included in site induction and training information.

    DL_G03
    Subject to the following conditions, this development licence allows you to: construct an organic waste processing facility, anaerobic digestion plant and energy recovery plant consisting of: a) a bunded feedstock receival and digestate processing shed capable of being maintained under negative pressure and containing 4 x 120m3 waste bunkers; b) anaerobic digestion process tanks including: i) 1 x inlet tank (1.461 ML), ii) 2 x enclosed anaerobic digestion tanks (3.461 ML each), iii) 1 x digestate outlet tank (1.461 ML); c) heat and power systems consisting of: i) 2 x 1.2MW CHP units, ii) 1 x enclosed biogas flare, iii) 1 x self-bunded 2.0kL diesel tank, iv) 1 x dual LPG/diesel boiler, v) 1 x plate/plate heat exchanger; d) a solid digestate treatment plant; e) a liquid digestate treatment plant; f) odour extraction and treatment system including: i) 8 x 54m3 bio-trickling filters; g) bunded tank farm with an effective storage capacity of 4,062m3; h) surface water catchment pond for non-contact water (375 kL); i) mechanical equipment and chemical dosing systems to enable the process; j) ancillary systems and equipment.
    DL_G04
    This permission does not take effect until a copy of any planning permit or amendment to a planning scheme required under the Planning and Environment Act 1987 (Vic) and related planning schemes has been provided to the Authority by the applicant.
    DL_G05
    This permission expires: (a) on the issue or amendment of an operating licence or permit relating to all activities covered by this permission; (b) when the Authority advises in writing that all activities covered by this permission have been satisfactorily completed and the issue or amendment of an operating licence or permit is not required; or c) on the expiry date listed on the front page of this permission.
    DL_G06.02
    You must: (a) provide the Authority with a financial assurance in a form and for an amount determined by the Authority, by a date specified by the Authority; and (b) maintain such financial assurance (including any part of such assurance) so that it can be claimed on, utilised or realised by the Authority as and when required.
    DL_G07
    You must: (a) develop and maintain a decommissioning plan that is in accordance with the current decommissioning guidelines published by the Authority; (b) provide the decommissioning plan to the Authority upon request; (c) supply to the Authority an updated detailed decommissioning plan 180 business days prior to commencement of decommissioning, if you propose to divest a section of the licensed site, cease part or all of the licensed activity or reduce the basis upon which the licence was granted to a point where licensing is no longer required; and (d) decommission the licensed site in accordance with the detailed decommissioning plan, to the satisfaction of the Authority and within any reasonable timeframe which may be specified by the Authority.
    DL_R01
    At least 45 days before the commencement of any commissioning, you must provide to the Authority a commissioning plan that include(s): a) a stack testing program to verify all air pollutant emission rates used in the modelling assessment of air quality impact; b) stack testing for particulates PM10 and PM2.5 and comparison against background air quality; c) measurement of biogas composition; d) determination of hydrogen sulphide reduction efficiency; e) a plan for a full biofilter assessment to prove conformance to EPA Publication 1880, including emissions criteria that includes odour character; f) odour field surveillance in accordance with EPA Publication 1881; g) calibration of online odour monitoring equipment against odour field surveillance observations; h) verification that the reception shed and drying shed can be maintained under negative pressure; i) a noise monitoring program to determine plant performance in accordance with the application and specifically a measurement program to ensure unreasonable noise, including low frequency noise will not be emitted at the onset of operation; j) an updated Feedstock Control Protocol document including waste acceptance procedures detailing measures in place to: i) facilitate inspection of each delivery, ii) minimise contamination received from the supplier, iii) maintain segregation of input materials, iv) prevent contamination of input materials from rejected waste streams; k) details of commissioning and proof of performance activities to verify that the performance objectives of each process unit are met; l) a monitoring and management plan for all wastes produced during commissioning which meets the requirements of: i) EPA Publication 1882.2 (March 2021) Waste disposal categories – characteristics and thresholds, ii) IWRG701 (June 2009) Sampling and analysis of waters, wastewaters, soils and wastes, iii) IWRG (June 2009) Soil sampling; m) a Fire Risk Management Plan in accordance with EPA Publication 1667.3 (July 2021) Management and storage of combustible recyclable and waste materials.
    DL_R02
    You must not commence commissioning of the operating components of the development activities until you have received the Authority's written approval of the reports/plans which is required pursuant to condition(s) DL_C05 and DL_R01.
    DL_R03
    You must not commence operation of the works until the Authority's written approval of the reports/plans required by condition(s) DL_C07 has been received.
    DL_R04
    At least 45 days before the commencement of any construction, you must provide to the Authority reports or plans that include(s): a) evidence that a Flood Impact Assessment Report has been completed to the satisfaction of Melbourne Water; b) a final drainage plan showing the segregation of clean stormwater (non-contact water) from contaminated water (contact water).
    DL_W01
    At least 45 days prior to commencing construction of the following components of the development activity, you must provide to the Authority for approval: a) final versions of Process and Instrumentation Diagrams (P&IDs); b) a HAZOP study for the anaerobic digestion process, energy recovery plant, solid digestate plant, liquid digestate plant and the odour extraction and treatment system; c) a revised acoustic report prepared to the satisfaction of the Authority, that must: i) be conducted in accordance with the Noise limit and assessment protocol for the control of noise from commercial, industrial and trade premises and entertainment venues (Noise Protocol, publication 1826) and consistent with the provisions of the Technical guide: Measuring and analysing industry noise and music noise (publication 1997); ii) include an examination of all noise sources in terms of their spectrum (1/3 octave band levels), particularly low frequency spectrum; iii) confirm that noise source levels used in the Noise Impact Assessment are consistent with installed values; iv) consider noise character (tonality, impulsiveness and intermittency); v) considers low frequency noise; vi) confirm the effective noise levels determined in the Noise Impact Assessment; vii) show any adjustments made for the determination of effective noise levels; viii) outline controls that will be implemented to minimise the risk of harm from noise (including, but not limited to low frequency noise); iv) consider measurement/calculation uncertainty; x) demonstrate that the contribution of the project to the effective noise level at noise sensitive areas will not exceed the noise limits calculated in accordance with Part I of the Noise Protocol minus five decibels (5 dB); and xi) detail contingency measures to be implemented to address, as necessary, the risk of exceedance of the project noise design objectives or of the noise limits of the Regulations, supported by evidence of their effectiveness.
    DL_W02
    You must notify the Authority in writing when the development activity authorised by this permission has commenced.
    DL_W03
    You must notify the Authority when the construction associated with the development activities covered by this approval has been completed.
    DL_W04
    You must not commission or use the operating components of the development activities without the written approval of the Authority.
    DL_W08
    You must install : a) an emergency flare in accordance with ISO 22580:20 Flares for combustion of biogas; b) continuous biogas monitoring of methane, carbon dioxide, carbon monoxide, oxygen, and hydrogen sulphide and hydrogen; c) continuous monitoring of biofilter inlet air temperature, inlet air relative humidity and biofilter back pressure monitoring as per EPA Publication 1880: Biofilter design and maintenance.     DL_W09.01
    You must install all exhaust stacks so that provisions for sampling are included in accordance with “A Guide to the Sampling and Analysis of Air Emissions and Air Quality” (EPA Publication 440.1, released December 2002), or as approved by the Authority.

    You must implement all liquid storage containment and handling measures in accordance with “Liquid storage and handling guidelines” (EPA Publication 1698, released June 2018).
    DL_W13
    During construction, you must ensure that all activities are carried out in accordance with a Construction Environmental Management Plan which includes a Spoil Management Plan.
