Without conviction, the defendant was ordered pursuant to s.67AC of the Act:
(a) To carry out a specified project for the public benefit by paying $30,000 to City of Boroondara within 30 days of this Order;
(b) To provide, with the City of Boroondara, a joint report to the Authority not later than 9 months from the date of this Order, confirming that payment has been received for the purpose of undertaking the following project and the status of the project:
(i) The preparation, planting and initial maintenance of a native vegetation batter along approximately 400m Gardiners Creek between the main body of Markham Reserve and Gardiners Creek designed to improve the water quality of the creek and rejuvenate the habitat for fauna.
