A service station that has already been fined twice for failing its environmental duties faces a further $18,000 in EPA Victoria fines.
The company, 111 762 362 Pty Ltd, owns a service station at 65-69 Keele Street, Collingwood and on several occasions EPA has required the company to take action to determine the nature and extent of contaminated groundwater and soil and to undertake an assessment of remedial options.
Despite the clear direction, that action has either missed deadlines or not been taken.
“The concern is that underground fuel tanks have leaked causing potential contamination of groundwater and soil,” said EPA Northern Metropolitan Regional Manager Steve Riley.
“The company and its director Dimitrious Andrianopoulos have previously been fined for non-compliance with EPA notices requiring they undertake measures to evaluate the extent of any contamination and propose how it will be managed.
“Our action is about protecting the health of the community and the environment and are a legal obligation. Failure to act on them is a breach of the law and we have imposed a further $18,000 in fines.
“With these fines and associated court costs, the company will have paid $36,000 for its lack of compliance and EPA is ready to escalate the matter back to the courts if our lawful directions are not followed.”
Service station operators with underground petroleum storage systems (UPSS) have a clear responsibility under Victoria’s General Environmental Duty to manage UPSS risks to minimise harm to human health and the environment so far as reasonably practicable.
Under the Environment Protection Act 2017 and the Infringements Act 2006, the company has the right to have the infringement notices reviewed or be considered by a court.
