| Background of offence or contravention | The Accused is the Director of Elite Roads Pty Ltd (ACN 152 328 704), a road construction company which provides services including asphalt paving and road profiling rehabilitation. In Victoria, Elite Roads operates from a premises located at 42-44 Aylesbury Drive, Altona VIC 3018 (the Premises). As a result of a notification to the Environment Protection Authority (EPA), it was understood that asphalt emulsion had been poured into a hole excavated at the Premises on or around 22 September 2023. On 5 October 2023, EPA Authorised Officers carried out an inspection of the Premises. During the inspection, the officers observed a hydrocarbon sheen on an area of disturbed soil at the south-west corner of the rear yard. In a follow up inspection on 14 November 2023, EPA Authorised Officers collected three samples from the premises which were analysed and elevated levels of hydrocarbons were found to be present in each of the samples. Two background samples were also taken outside of the Premises, east of the boundary fence at the rear yard. These samples were analysed and found to contain minimal hydrocarbon contamination compared to the three samples taken within the Premises. |
