Background of offence or contravention

111 762 362 Pty Ltd (formerly known as Filomena Pty Ltd) is the sole registered proprietor and landlord of the premises at 318 Wellington Street, Collingwood. Mr. Andrianopoulos is the company's sole director. The Premises is currently and has historically been used as a petroleum service station. Activities at the premises have caused petroleum hydrocarbon contamination of groundwater and soil beneath the premises.

In 2022, a detailed site investigation report (DSI Report) by the company's environmental consultant found that land use had likely caused hydrocarbon, BTEX and MAH contamination of groundwater and potentially soil beneath the site, and that contamination is considered likely to be moving offsite.

In response, on 3 February 2023, Environment Protection Authority (EPA) issued environmental action notice, requiring further sampling works identified as required within the DSI Report.

Following a period of 7 months between 24 April 2023 and 14 November 2023, EPA Authorised Officers attempted to contact 111 762 362 Pty Ltd via telephone and email at least eight times to discuss non-compliance. Contact was made in March 2024 where non-compliance was discussed, however, EPA did not receive any reports from the company demonstrating compliance.

On 19 April 2024, an Information Gathering Notice was issued to 111 762 362 Pty Ltd requiring it to provide recent data and certification from maintenance and equipment integrity testing conducted on underground fuel tanks and associated fuel lines at the premises. As of 8 May 2024, the company failed to respond to the requirements of the IGN.

At the time of proceedings, the required testing had been completed but the required report was outstanding.
