Background of offence or contravention | On 5th May 2021, solicitors acting for the accused requested EPA consider resolving the charges by offering a Diversion Plan with conditions for Robert Earl and withdrawing the charge against the Company (R.J. & C.M. Earl Civil Mechanical). On 11th May 2021, EPA served a Diversion Notice on Robert Earl recommending him as suitable for a Diversion Order and proposed the following conditions by the Court: 1. That he be of good behaviour for a period of 6 months. 2. That he pay a donation of $8,261.00 (being the value of the original infringement fine) to the Magistrates' Court Fund. 3. That he sends a letter of gratitude to the Informant. On 16 June 2021, a decision was made by the Court on the papers approving a Diversion Plan for Robert Earl and ordering a withdrawal of the charge against the Company. |
