| Background of offence or contravention | The accused leased a property in Whittlesea. On 2 December 2021, EPA received a pollution report in relation illegal dumping on the premises. EPA attended the premises and conducted an inspection at the premises, where they observed large heavy vehicle tyre tracks, several large piles of waste and CCTV cameras which had been installed without the knowledge or consent of the landlord. There was a large patch of land that had been recently disturbed with an excavator nearby. The accused was served an information gathering notice (IGN) to identify who leased the excavator and provided information that was subsequently found to be false and misleading. Additionally, the accused was also provided with a notice to investigate (NTI), which they failed to comply with. |
