| Background of offence or contravention | On 2 May 2025, EPA officers attended a property following a fire involving a large stockpile of waste. Investigations identified construction and demolition waste, including asbestos-containing material, mixed with soil and other waste that had been deposited on the land. EPA subsequently issued an Environmental Action Notice requiring the accused to stop accepting and burning waste, and to classify and remove the waste from the premises. The notice was not complied with. Multiple trucks continued to deliver industrial waste to the premises despite the property not being authorised to receive or deposit industrial waste under the Environment Protection Act. |
