| Background of offence or contravention | Mr Ollington is the owner of a car wreckers’ yard in Mildura. As part of his business, he has accepted numerous scrap vehicles and accumulated a number of waste tires (estimated to be approximately 1,000 car, motorbike, truck and tractor tires). At an inspection, EPA staff provided Mr Ollington with compliance advice that he was required to remove these tires as he was engaging in a prescribed activity (storage of waste tires) without a registration, and that the tyres were creating a risk, especially in a fire prone region of Victoria. EPA officers issued Mr Ollington with an EAN requiring the removal of the waste tyres from the premises. He failed to comply with the EAN as he did not remove the waste tyres from the premises and dispose of them at a facility permitted to accept them. |

Court orders made
Without conviction, Mr Ollington was Sentenced to an Adjourned Undertaking, to be of good behaviour for a period of 12 months. As part of the Adjourned Undertaking, there are several special conditions included, which are as follows:
- Accused is to apply for registration (A09b) by 15 April 2026 (to keep tyres at his premises, but in a manner which meets EPA requirements).
- In the event that A09b Registration is not obtained, the conditions of a s331 General Restoration & Prevention Order will apply, requiring the accused to remove waste tyres by 30 Oct 2026 (beginning of next fire danger period), provide monthly updates about their removal, and provide confirmation of their disposal at a place which accepts them.
Mr Ollington was ordered to pay EPA costs of $2,500.
