Background of offence or contravention

MST1 Pty Ltd (‘MTS1’) was primarily a metal recycler, receiving and recovering waste metals from businesses and the public to be recycled and onsold or repurposed. Waste was received at the premises and then sorted to identify materials for recycling.

On 2 January 2024, a fire took place at MST1's premises in Laverton North. MST1 was charged with breaching the General Environmental Duty, specifically, with contravening section 25(2) of the Act, in that MST1 failed to use and maintain systems for identification, assessment and control of risks to the environment from pollution and waste that may arise in connection with its activity.
