| Background of offence or contravention | The Accused is a director of Hi-Quality Quarry Products Pty. Hi-Quality Quarry Products own a 181 hectare parcel of land at 570 Sunbury Road, Bulla, which is a premises that forms part of a larger landholding owned by the Hi-Quality Group used for a range of waste and resource recovery activities which is approximately 261 hectares. Hi-Quality is authorised under an operating licence to operate a prescribed industrial waste landfill facility at the Premises. A condition of the licence is that the licence holder will notify and receive written approval from the Environment Protection Authority (EPA) before constructing a new landfill cell. On 16 January 2023, Hi-Quality submitted a letter to EPA which provided notification of its intent to construct a new landfill cell at the Premises. Between 20 March 2023 and 14 September 2023, EPA and Hi-Quality engaged in numerous discussions regarding cell design and requests for further information for verification. On 16 September 2023, Nearmap satellite images of the Premises revealed that construction had commenced, and on 22 September 2023, Hi-Quality emailed EPA to confirm that this was the case. On 23 October 2023, the EPA provided Hi-Quality with conditional design approval for the construction. |
