| Background of offence or contravention | The Accused is a director of Glen Ora Estate Pty Ltd. Glen Ora Estate Pty Ltd own the southern section of roads which run through and surround the vacant development land known as Solomon Heights Estate in Sunshine North, where industrial waste stockpiles were identified by Environment Protection Authority (EPA) Officers during an inspection on 24 February 2021. During the inspection on 24 February 2021 EPA officers observed one stockpile containing materials consistent with a by-product of metal reprocessing including plastics, glass and metals as well as wood chips, tiles and cement sheeting, and another stockpile consisting of soil, tiles, bricks and cement sheeting. The stockpiles contained asbestos and concentrations of copper and lead. On 25 March 2021, EPA Authorised Officers attended the premises, served a Clean Up Notice, and observed material consistent with the previously dumped industrial waste had been added to the stockpile. A compliance inspection on 29 April 2021 revealed that temporary fencing, tarp and signage indicating the presence of asbestos had been placed. On 16 September 2021, EPA Officers visited the Premises to conduct a notice compliance inspection. It was observed that the premises still had industrial waste. Glen Ora Estate were granted several extensions to the Environmental Action Notice which was issued subsequent to the initial Clean Up Notice. The site was remediated by early 2025. |
