You can apply at any time to have us review the amount or the accepted form of your financial assurance.
You can also apply to have us release all or part of your financial assurance. We release all or part of a financial assurance when:
- you stop holding the environmentally hazardous substances the financial assurance was for
- you stop holding the permission, site management order or environmental action notice that the financial assurance was for
- you transfer your permission to another person who has lodged their financial assurance with us
- in a review, we find that your financial assurance is not needed or the amount needs reducing.
We can also transfer your financial assurance to another activity. For example, the financial assurance for a revoked landfill operating licence can be transferred to a site management order for long-term environmental management.
How to apply
There's no fee to request that we review the amount of your financial assurance.
You need to pay fees to request that we:
- review the form of financial assurance we accept
- release all or part of your financial assurance.
Complete our Application for review or release of financial assurance.
The application form and fee may not be needed if:
- your permission is reviewed, varied, surrendered or transferred
- the costs of your remediation or clean-up change
- we review or revoke your environmental action notice or site management order
- we update our method for calculating the amount of financial assurance
- we review your financial assurance and decide it's not required or it needs amending.
