Under the Circular Economy (Waste Reduction and Recycling) Act 2021 (CE Act), responsible entities must prepare a Responsible Entity Risk, Consequence and Contingency Plan (RERCC Plan) and a Statement of Assurance.
Your RERCC Plan must comply with the current Circular Economy Risk, Consequence and Contingency (CERCC) Plan.
A RERCC Plan helps you:
- identify risks that could seriously affect waste, recycling or resource recovery services
- explain what actions you are taking, or plan to take, to reduce or prevent those risks
- address any relevant measures in the CERCC Plan.
How to prepare a RERRC Plan and Statement of Assurance
The CE Act and Circular Economy (Waste Reduction and Recycling) (Risk, Consequence and Contingency Plans and Other Matters) Regulations 2023 (the regulations) set out the information that must be included in a RERCC Plan. See Regulation 12 for the minimum requirements.
To help responsible entities meet these requirements, we have developed a guidance document and template. The template aligns with the requirements of the CE Act and regulations and can help you meet your reporting obligations.

You can also create your own RERCC Plan and Statement of Assurance, as long as they meet all requirements under the CE Act and the regulations.
Complying with a RERCC Plan
After you submit your RERCC Plan, you must:
- follow the plan
- monitor how it is being implemented.
If you become aware that you cannot meet any part of your plan, you must tell us as soon as possible by:
- emailing responsible.entity@epa.vic.gov.au
- calling 1300 372 842.
Penalties apply under Sections 74D and 74H of the CE Act if you do not comply with your RERCC Plan or notification requirements.

Information privacy and security
Information provided by responsible entities will be stored and managed in accordance with the Victorian Government guidelines for information and assets security.
Exemptions
You may apply for an exemption from some regulatory requirements, relating to the content of your RERCC Plan.
Exemptions cannot be granted for:
- complying with the current CERCC Plan
- preparing and submitting a RERCC Plan
- submitting a Statement of Assurance.
