We regulate thermal waste to energy facilities under the Circular Economy (Waste Reduction and Recycling Act) 2021 (CE Act) and the Environment Protection Act 2017.
Anyone seeking to operate a thermal waste to energy facility in Victoria must obtain a development licence and an operating licence under the Environment Protection Act and a cap licence under the CE Act.
These are separate processes and each application is assessed independently and in accordance with legislative obligations.
Victoria’s Waste to Energy Scheme sets the amount and types of waste that operators can process using thermal waste to energy.
Only waste that can't be recycled can be processed by thermal waste to energy facilities.
