When you manage or control industrial waste to be transported, you must take all reasonable steps to make sure it's transported to a place authorised to receive it.
You manage or control industrial waste if you:
- produce or generate it
- collect, consign, transfer or transport it
- receive, handle or store it
- undertake resource recovery or process it
- dispose of it.

Who it applies to
Any business or person who:
- manages or controls industrial waste
- intends to have the waste transported.
What you must do
You must take all reasonable steps to:
- identify and classify your industrial waste
- provide enough information about your industrial waste to the transporter so they can take your waste to a lawful place
- check that your waste will be taken to a lawful place.
There are penalties if you do not meet this duty.
Example
Sam manages industrial waste for a facility. He:
- identifies and classifies the waste
- provides this information to a waste transportation company
- enters into a contract with the waste transportation company for regular pick-up of the facility's industrial waste
- checks the contract to see which waste facility the waste is being taken to.
Sam:
- looks up this waste facility on our public register
- confirms the facility can lawfully receive the waste
- allows the transporter to take the waste.
