Industrial waste can only be deposited or abandoned at a place authorised to receive that type of industrial waste.
Deposit includes:
- taking waste to a place or premises
- disposing of waste at a place or premises
- disposing of waste by burial or burning, even if burying or burning on your own site.

Who it applies to
Any business or person who deposits or abandons industrial waste, including those that take waste to a place or premises.
What you must do
You must:
- take industrial waste to a place that is authorised to receive that type of industrial waste (a lawful place)
- deposit industrial waste with the agreement (consent) of the person in charge of the place authorised to receive it.
There are penalties if you do not meet this duty.
Example
Georgia manages a large building leased and used by several businesses. The businesses produce cardboard, paper and plastic waste.
Georgia contracts a waste transport company to take the waste to a recycling facility.
The waste transport company:
- looks up the recycling facility on our public register
- confirms that the recycling facility is authorised to receive this type of waste.
The waste transport company transports waste from Georgia's building to the recycling facility. The recycling facility agrees to accept it.
