An enforceable undertaking is a written and formal agreement to address an issue or offence. You volunteer to enter into it. You agree with us what actions you'll take. This agreement is legally binding.
We can use an enforceable undertaking instead of criminal prosecution or a civil proceeding. It may help achieve restorative justice outcomes.
Because it's legally enforceable, we can start court action if you do not meet your agreement.

When an enforceable undertaking is suitable
An enforceable undertaking is suitable when:
- you want to take active responsibility for an issue or offence
- it can address any harm caused to human health or the environment.
An enforceable undertaking should:
- deliver positive outcomes
- support changes within your business that prevent you from breaking the law in future
- support your industry sector to better understand risks and how to control them.
