Fine for littering from a vehicle

What to do when you get fined for littering from a vehicle.

It is an offence to litter from your vehicle. As the registered owner, you are also responsible if a passenger litters from your vehicle. Litter reports are investigated and fines may be issued by an Authorised Officer to individuals and companies.

If you receive a littering fine

You can:

  • pay the fine
  • apply for an internal review
  • request to take your fine to court
  • nominate the responsible person (if it was not you).

How to pay the fine

Go to court

You can request a court hearing for a magistrate or judge to decide the outcome.

Send your request by email to contact@epa.vic.gov.au.

Nominate the responsible person

If you were not responsible, you can nominate the person who was within 10 business days from the infringement issue date.

Once the fine is referred to Fines Victoria, you may not be able to nominate.

Download the form and follow these steps:

1. You can nominate if:

  • someone else littered from your vehicle
  • you sold or disposed of the vehicle before the offence date
  • the vehicle or number plates displayed on the vehicle were stolen or cloned.

2. Requirements:

  • provide the responsible person’s full name and current address
  • complete the nomination statutory declaration form
  • have the form witnessed by an authorised witness.

3. Submit the form

  • applying for a review
  • contact Fines Victoria to apply for a review under the Family Violence Scheme.

Litter fines

Litter fines apply to both individuals and companies. Infringement penalty amounts vary depending on the offence. Refer to Schedule 10 of the Environment Protection Regulations 2021 for further information.
