- Background of offence
Charge 1:
Bradbury contravened a condition of a licence, the relevant condition prohibited Bradbury from storing more than 154,000 litres of liquid waste at its premises in Thornycroft Street, Campbellfiled. The EPA estimated there to be approximately 450 1000L IBCs containing burner fuel and other liquid waste were stored at the premises however it was conceded that not all of the IBCs weer full and the total amount would have been significantly less than 450,000L The circumstances in which excess burner fuel product came be stored at the premises was well known to the EPA. The burner fuel had been moved to Thornycroft from Brooklyn Court as a consequence of an Improvement Notice issued by WorkSafe.
Charges 2 and 3:
Bradbury polluted and caused an environmental hazard to the waters of Merlynston Creek as a result of the fire which occurred on 5 April 2019. A large quantity of fire water was directed onto the premises during the course of firefighting activities. Fire water run-off was observed draining from the premises and running along the gutter of Thornycroft Street and into a stormwater drain which fed into a retarding basin and the Creek.
