Charges:

1. Deposit industrial waste without authority at Ardmona from 29 March 2023 to 07 April 2023, contrary to s.133(3).

2. Deposit industrial waste without authority at Ardmona on 07 April 2023, contrary to s.133(3).

3. Failed to comply with Environmental Action Notice (EAN) at Ardmona from 28 August 2023 to 21 September 2023, contrary to s.290(1).

On 07 March 2023, a Facebook post by the director accused offered free demolition materials in Shepparton. Victim DANDA responded, seeking wood and trees. Between 29 March 2023 and 30 March 2023, Demolition Masters delivered waste (20-40% wood, 40-60% trees, and the remaining 20-25% as construction debris) across 3 loads to DANDA’s property.

On 07 April 2023, additional waste (construction and demolition debris) was deposited, contrary to without Victim DANDA’s permission. Part of the waste included asbestos.

EPA officers inspected the site on 11 May 2023, finding waste and suspected asbestos. Samples confirmed chrysotile asbestos present.

An Environmental Action Notice (EAN) was issued on 25 July 2023, an Environmental Action Notice required Demolition Masters to remove all industrial waste, including asbestos, by 28 August 28 2023. On 21  September 2023, an inspection revealed remaining waste. DANDA informed the EPA that Demolition Masters’ had not returned or organised for any of the waste to be removed.
