- Background of offence
Jason Kilday operates a business called ‘Jim’s Hazardous Material Removal’. He received a job to remove asbestos from a property in Torquay.
He engaged the services of Peter Ranton to complete the asbestos removal work.
On 30 September 2021 Department of Environment, Land, Water and Planning (DELWP) officers observed Ranton loading what appeared to be asbestos sheet into his trailer.
Victoria Police were notified of the observations and were asked to assist in intercepting the vehicle as it left the property, allowing EPA officers to take samples from the load.
Jason Kilday and Peter Ranton both entered a guilty plea in the Geelong Magistrates’ Court on charges of causing or allowing the transporting of reportable priority waste without the appropriate EPA Registration.
Kilday was fined $4,000 without conviction and ordered to pay $2,086 in court cost to EPA.
Ranton was convicted and fined $2,000. He was also ordered to pay $2,086 costs to EPA.
