Background of offence
In January 2018, EPA officers inspected the premises at 82 (Lot1/TP9631) Sutton Road, Maryborough and observed significant volumes of industrial waste.

In February 2018, EPA issued a clean up notice requiring Mr Landsborough to remove all industrial waste from the premises by 31 October 2018.

Although significant amounts of waste had been removed, Mr Landsborough failed to remove all industrial waste and the clean up notice was revoked.

In December 2018, EPA issued a second clean up requiring Mr Landsborough to remove the remaining industrial waste from the premises by 8 March 2019.

In January 2019, EPA officers inspected the premises and observed additional waste had been deposited on the premises.

In March 2019, EPA officers inspected the premises and observed that all industrial waste on the premises had not been removed as required by the second clean up notice.

Mr Landsborough made admissions that he had deposited the industrial waste on the premises himself. His reason for failing to comply with the clean up notice was that he ran out of money.

As at 17 February 2021, stockpiles of industrial waste remained on the premises.
