1. Did unlawfully deposit waste (Dangerous litter) at Hallam on 05.02.2022 contrary to s.155(2) of the Environment Protection Act 2017.
- Background of offence
On Saturday, 5 February 2022 at approximately 11:00 AM at a location close to the intersection of Belgrave Hallam Road and the Princes Highway, Hallam, a witness (an off-duty police member) observed the driver of a vehicle drop a lit cigarette onto the road as the driver slowed for a red light.
The witness took photos of the vehicle as the traffic started to drive through the intersection with a green light.
The observations were reported to the Environmental Protection Authority, and the Authority served an infringement notice pursuant to section 115(2) of the Act, to the accused, being the registered owner of the vehicle. The infringement notice contained details with respect to providing a nomination.
On 28 February 2022, the accused elected to have the matter of the infringement notice determined by Court.
The accused had no prior convictions.
