Background of offence
The accused was the holder of an EPA licence to operate the Patho Landfill. Between 5 January 2023 and 13 January 2023, the accused breached their licence conditions on three separate days by failing to ensure that all waste in the cells was covered, failing to implement sufficient litter controls and failing to limit the size of the tipping face. The accused had previously been provided with compliance advice in relation to the above matters between 28 September 2022 and 25 November 2022. The accused does not have any priors
